TextHouston.com SMS Terms and Conditions

The following Terms and Conditions govern your use of the TextHouston.com SMS Service (the "Service"). Your use of any part of the Service constitutes your agreement with these Terms and Conditions.

1. DESCRIPTION OF THE SERVICE. Subscribers to the Service will receive via SMS/text messages delivered to their mobile telephones/devices information about news, events, promotions, and special offers from various TextHouston.com partners.

2. HOW TO JOIN. You must be at least 13 years old to subscribe to the Service. To join the Service, you must provide your mobile telephone/device number. You will then receive a text message at that mobile telephone/device number requiring a response from you via your mobile telephone/device confirming that you want to join the Service. By sending the confirmation, you "opt-in" and agree to subscribe to the Service and to comply with these Terms and Conditions.

3. COST. TextHouston.com does not charge you to subscribe to the Service; however, please check with your mobile service provider in case your mobile service plan charges for sending and/or receiving text messages and/or air time. All charges are billed by and payable to your mobile service provider. Message & Data rates may apply.

4. NUMBER OF MESSAGES. TextHouston.com will send no more than 1 text messages per day, excluding any network or Service required updates.

5. OPTING OUT. You can opt-out of the Service at any time by texting the word "STOP" from your mobile telephone/device to 713713. Allow up to 5 business days to be completely removed from the TextHouston.com subscriber list and no longer receive messages..

6. ELIGIBLE MOBILE SERVICE PROVIDERS. The Service is currently available on the following mobile service providers: Alltel, AT&T, Boost, Cellcom, Cellular South, Nextel, nTelos, Sprint, T-Mobile, U.S. Cellular, Verizon Wireless, and Virgin Mobile. TextHouston.com may add or remove mobile service providers from the Service at any time, so please check these Terms and Conditions for an accurate and current list.

7. VERIFICATION. By participating in the Service, you acknowledge and agree that: (1) the mobile telephone/device number you provide during the Service registration process is registered in your name, and (2) you will not initiate messages to the mobile telephone/device of any other person or entity in connection with the Service.

8. CONTENT. You agree not to modify the format of the content provided to you by your participation in the Service (the "Content") or to add any materials, including advertisements or other promotional material, to the Content. You acknowledge and agree that TextHouston.com owns the Content and that the Content is protected by intellectual property law.

9. LICENSE. TextHouston.com grants you a limited, non-exclusive, non-sublicenseable, non-transferable, revocable license to view and use the Service. All Content provided to you remains the property of TextHouston.com. You may download and use the Content on a compatible mobile telephone/device, solely for your own personal, non-commercial use. You may forward the Content to those you know and retain a copy of the Content for your personal use, but you may not otherwise reproduce, modify, transfer, distribute, sell, or otherwise use or make available the Content or the Service except as expressly provided in these Terms and Conditions.

10. LIABILITY/DISCLAIMER. TextHouston.com provides the Service "as is," and it and its employees, affiliates, subsidiaries, advertising and promotion agencies, and all other entities or individuals associated with the development or administration of the Service shall not be held liable for your use of the Content or any other information or material contained therein or any other aspect of the Service. TextHouston.com does not warrant or make any representations of any kind or nature with respect to the Service, and TextHouston.com does not assume or have any responsibility or liability for any claims, damages, or losses resulting from your use of the Service. TextHouston.com nor any of its affiliates shall have any liability to you for use charges related to any device that you use to access the Service or use and receive the Service, including, without limitation, charges for mobile telephones/devices. TextHouston.com shall not be liable for any delay in the receipt of any messages or Content, as delivery is subject to effective transmission from your network operator/mobile service provider. TextHouston.com AND ITS AFFILIATES DISCLAIM ALL WARRANTIES WITH REGARD TO THE SERVICE, INCLUDING WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE TO THE FULLEST EXTENT ALLOWED BY LAW.

11. PRIVACY. TextHouston.com will only use information you provide in connection with the Service to transmit the Content or as otherwise described in these Terms and Conditions; however, TextHouston.com reserves the right, at all times, to disclose any information, including your identity, as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect its rights and/or property. By registering for and participating in the Service, you agree to provide accurate, complete, and true information. If TextHouston.com in its sole and absolute discretion, believes that any information you provide is untrue, inaccurate, or incomplete, it may refuse your access to the Service and pursue any appropriate legal remedies.
